General Terms and Conditions of the Online Store Silkbase.eu

Article I

Definitions

The operator of the website silkbase.eu is the company:

The Seller is the company Silkbase, s.r.o.
The Supplier of goods and services offered in the silkbase.eu e-shop is Silkbase, s.r.o.

The Buyer is any visitor of the e-shop who creates an order via the e-shop. For the purposes of Act No. 102/2014 Coll., a Consumer means a natural person who does not purchase goods for resale to other persons or for business, employment, or professional purposes.

An E-shop is a computer system located on the Internet with public access that enables ordering goods or services.

Goods or services are all products published on the e-shop website.

An Order is created by confirming the ordering process in the e-shop by selecting goods or services by the buyer, including the complete filling in of the order form.

The Buyer fully acknowledges electronic communication, primarily via the e-shop, e-mail communication, as well as telephone communication.


Article II

Price

All prices listed for goods are final and include 23% VAT.
The Seller is bound by the price stated on the e-shop website at the moment of purchase.


Article III

Order

An order is created by confirming the ordering process in the e-shop by selecting goods or services by the buyer, including the complete filling in of the order form. For proper order processing, it is necessary to fill in the required data and choose delivery and payment options.

By submitting the order, the Buyer agrees with the price of the ordered goods and services and the order becomes binding for the consumer.

Upon confirmation of the order by the Seller, a purchase contract is concluded, which may be amended, canceled, or supplemented only by mutual agreement between the Buyer and the Seller, unless otherwise provided by law.

After creating an order, the Buyer will automatically receive an e-mail confirming receipt of the order by the e-shop. This e-mail does not constitute confirmation of the goods under paragraph 3 of this article.

By submitting the order, the Buyer is obliged to pay the purchase price of the ordered goods.

By entering the website, the Buyer confirms that they are over 18 years of age, confirms this again at checkout before completing the order, and finally upon receiving the order. Orders will not be released by the carrier to buyers under 18 years of age and will be canceled.


Article IV

Payment Terms

Payment for goods and services in the e-shop can be made by the following methods:

  1. Cash on delivery – payment in cash or by card to the carrier upon receipt of the goods

  2. Bank transfer based on a proforma invoice – payment in advance; goods will be dispatched after receipt of funds in our account or after providing proof of payment. Verified customers may receive goods immediately at the Seller’s discretion.

  3. Payment by card – payment in advance; goods will be dispatched after funds are credited to the system.

Additional charges for individual payment methods are listed in Article VI of these Terms and Conditions.


Article V

Delivery Terms

The Seller is obliged to dispatch the goods to the Buyer within 30 days from the conclusion of the purchase contract, unless otherwise agreed or unless a longer delivery period is specified for the product.

If goods are in stock, they are dispatched as soon as possible according to capacity.

If an order contains multiple goods or services and some are out of stock, the Buyer will be informed with options for partial deliveries.

Along with the physical shipment, the Buyer will receive an electronic PDF invoice (tax document), instructions, and other documents related to the goods or services.

The place of performance is considered to be the location to which the goods are delivered.

The Seller provides delivery via:

  • GLS

  • Packeta


Article VI

Shipping, Packaging, and Payment Fees

Shipping prices are always updated in the e-shop checkout before completing the order.

The Seller may agree with the Buyer on non-standard delivery methods or prices.

The Seller may ship immediately available goods and deliver the remaining part later within the legal period, provided no additional shipping fees are charged beyond those included in the order.


Article VII

Transfer of Ownership

Ownership of the goods passes from the Seller to the Buyer only upon full payment of the purchase price.

For goods for which ownership has not yet passed, the Seller reserves the right to process claims only after full payment of the purchase price.


Article VIII

Cancellation of the Purchase Contract

The Buyer has the right to cancel the order at any time before dispatch, always in writing, via the e-mail address listed in the contact form or via message on our messenger.


Article IX

Consumer’s Right to Withdraw from the Contract Without Giving a Reason

In accordance with Act No. 102/2014 Coll., the Consumer has the right to withdraw from the purchase contract within 14 calendar days from the date of receipt of the goods. The Consumer may also withdraw before delivery.

This right does not apply to products intended for oral use or liquids with a broken seal for hygiene reasons.

The Consumer must deliver or send written notice of withdrawal no later than the last day of the withdrawal period to the Seller’s contact address. The goods must be returned with all documentation within 14 days of withdrawal.

Goods must not be sent cash on delivery.

The Seller will refund all payments, including delivery costs, within 14 days of receiving the withdrawal notice, but not before receiving the goods or proof of shipment.

Return shipping costs are borne by the Consumer.

The Consumer is liable for any reduction in value caused by handling beyond what is necessary to determine the nature and characteristics of the goods.


Article X

Rights and Obligations of the Contracting Parties

The Buyer is obliged to:

  • accept the ordered goods

  • pay the agreed price

  • report any damage or discrepancies with photos to shop@silkbase.eu

The Seller is obliged to:

  • deliver goods in the agreed quality, quantity, and price

  • provide invoices and documentation (digitally)


Article XI

Personal and Payment Data Protection

The Buyer agrees to the processing of personal data in accordance with Act No. 122/2013 Coll. for a period of five years. Consent may be withdrawn in writing at any time.

The Seller does not access payment card data or login credentials. Payment gateways are fully responsible for data protection.


Article XII

Information on Personal Data Processing

Personal data are processed solely for order fulfillment and delivery. Data are not disclosed to third parties or transferred outside the EU.

The Buyer has rights to access, correct, delete, or object to the processing of their personal data as provided by law.


Article XIII

Compensation for Damage Due to Non-Acceptance of Goods

If the Buyer fails to collect ordered goods, the Seller has the right to claim compensation for costs associated with preparation and shipment.


Article XIV

Final Provisions

The Seller reserves the right to amend these Terms and Conditions without prior notice. The version valid at the time of order submission applies.

These Terms and Conditions enter into force on June 5, 2017.

In case of disputes, Consumers may contact the Slovak Trade Inspection or use the EU Online Dispute Resolution platform.

Complaints Policy of the Online Store Silkbase.eu

Complaints may be made only for goods purchased from the Seller.

Consumers are entitled to a 24-month warranty; business customers have a 12-month warranty.

The Buyer must submit a complaint immediately after discovering a defect.

Complaints are excluded for damage caused by misuse, improper handling, wear and tear, or force majeure.

The Seller will confirm receipt and process the complaint within 30 days.

If the complaint is not resolved within 30 days, the Buyer has the right to withdraw from the contract or request replacement.
